​Requirements for Filing a Lawsuit with the CRSD

 

1) A complaint must be filed first with the Capital Market Authority (CMA) before filing the lawsuit with the CRSD, and a ninety-days period must elapse from the date of filing the complaint, unless the CMA notifies the complainant that filing the lawsuit with the CRSD is permissible before the expiry of such period.

2) Sign-up with the website of the GS-CRSD through "Electronic Services." The username is the national ID number for individuals, and the email address for listed and licensed companies. For other companies, the username is the Unified National Number.

3) Submit the lawsuit through the electronic system.

4) Enter the complaint number issued by the CMA to retrieve the complaint details, and ensuring that the information in the lawsuit matches the information in the complaint filed with the CMA to initiate the lawsuit.

5) Fill out the claimant's information completely, and the information of the claimant's representative (agent), if any.

6) Fill out the respondent's information completely, which is mandatory for both individuals and companies (national ID number or Unified National Number for companies, full name, and full address). As for listed and licensed companies, they are selected from the list.

7) Fill out the case details (the case must be on the same subject as the complaint submitted to the CMA.

8) Upload all mandatory case documents in the specified file formats (claimant's national ID, residency permit or passport for non-Saudis, or the Unified National Number for companies.

9) Upload supporting do​cuments for the case. If there are supporting documents in a language other than Arabic, they must be translated by a certified translation office and uploaded with the documents.

10) If representing another party by lawyers, or those exempted according to the provisions of Article (18) of the Lawyers' Law, they must adhere to the conditions of the power of attorney; which include: the claimant registering themselves, filing the case, designating a representative in the case according to the terms of the power of attorney, providing proof of this designation, in addition to uploading the power of attorney and the necessary documents to the electronic system, including the lawyer's license or legal representation.

11) Capital Market Institutions and Listed Joint-stock Companies in all lawsuits of which they are parties, must ensure that all lawsuits are filed or represented by a lawyer or legal representative licensed in the Kingdom od Saudi Arabia.
